Fatti all'origine della controversia • Il J. giocatore, nato il 13 febbraio 1984, è stato registrato per il K. squadra dal 30 agosto 2002 al 3 luglio 2003, quindi per uno stagione sportiva età compresa tra i 18 e 19. • Nel luglio 2003 la J. giocatore è stato trasferito dal K. club al club di S. Secondo l'Associazione Calcio, con cui il S. club è affiliato, ha unito il suo club in un non-dilettante capacità. • Il club di K. sostiene l'indennità di formazione ai sensi del capitolo VII. del Regolamento FIFA sullo status e sui trasferimenti dei calciatori. • Secondo la FIFA non circolare. 826 del 31 ottobre 2002, che riguarda, tra l'altro, la categorizzazione delle società calcistiche, K. club è un club di seconda divisione, appartenente alla categoria 2. S. Il club è un club di prima divisione, appartenente alla categoria 2. • Il club di S. offerto di pagare l'importo di USD 10'000. Presumibilmente, ciò corrisponde all'importo medio dei costi di formazione normalmente speso dai club di quel paese per anni diviso per il numero medio di giocatori in un club. K. Il club, però, rifiuta questa offerta e ritiene che l'indennità di formazione deve essere calcolato sulla base del regolamento FIFA e circolari. Considerazioni della Camera di Risoluzione delle Controversie I membri della Camera di Risoluzione delle Controversie sono stati convocati per passare una decisione su tale questione dal presidente ai sensi dell'art. 1 punto 6) del Regolamento prassi e procedure della Camera di Risoluzione delle Controversie. Il corpo di decidere iniziato le sue deliberazioni facendo riferimento all'art. 42 par. 1 lit. (B) (iv) del Regolamento FIFA sullo status e sul trasferimento dei giocatori (in prosieguo: il Regolamento), secondo la quale esso rientra nella competenza della Camera di Risoluzione delle Controversie di esaminare le controversie relative spese di indennità di formazione. Di conseguenza, la Camera ha stabilito che era competente a trattare la vicenda attuale. Successivamente, ed entrando nel merito della questione, la Camera ha riconosciuto che il capitolo VII. del Regolamento stabilisce, tra l'altro, che l'indennità di formazione è dovuta per la formazione sostenute età compresa tra i 12 e 21, se il giocatore non conclude un dilettante contratto prima all'età di 23 anni. Il corpo di decidere sottolineato che, nel caso in esame, il periodo di formazione da prendere in considerazione è la stagione sportiva 2002/2003 quando il J. giocatore era tra i 18 ei 19 anni. Inoltre, ha sottolineato che al momento del suo trasferimento al S. club del giocatore in questione era 19 anni, e che si unì al suo nuovo club in un non-dilettante capacità. In considerazione di quanto sopra, la Camera di Risoluzione delle Controversie ha concluso che, indiscutibilmente, il K. club ha diritto di ottenere il risarcimento per la formazione e l'educazione della J. giocatore per la stagione sportiva che il giocatore trascorso con il club di K. in continuazione, la Camera ha spiegato che l'importo dovuto dal club di S. deve essere calcolato ai sensi dell'art. 7 del regolamento FIFA che disciplina l'applicazione del Regolamento sullo status e il trasferimento dei calciatori (in prosieguo: il Regolamento di applicazione), applicando i parametri forniti dalla FIFA lettera circolare n. 826 del 31 ottobre 2002. Ai sensi dell'art. 7 par. 3 del Regolamento di applicazione, come principio generale, la compensazione relativa è determinata dai costi di formazione e di istruzione del paese in cui si trova il nuovo club. A questo proposito, e in modo da chiarire il significato di tale clausola, il corpo decide di cui al punto 2., B., (I) della lettera circolare n FIFA. 769 del 24 agosto 2001 e ha riconosciuto che, in caso di un trasferimento di un giocatore da un paese all'interno della UE / SEE in un paese al di fuori dell'UE / SEE, quando è dovuta l'indennità di formazione che si basa sui costi del paese di il nuovo club tenendo la categoria del club che ha effettivamente formato il giocatore. Art. 7 par. 1 del Regolamento di applicazione conferma il principio detto ("La compensazione per la formazione e l'istruzione si ottiene moltiplicando l'importo corrispondente alla categoria delle società di formazione ...") (siamo noi che sottolineano). La Camera di Risoluzione delle Controversie ricordato che la rivendicazione del club K. è un club di seconda divisione, appartenente alla categoria 2 e, inoltre, che il J. giocatore è stato trasferito ad un club della regione asiatica. La lettera circolare n. 826 stabilisce che l'importo indicativo di categoria 2 per il paese di S. club (Asia) è di USD 40.000 per anno di formazione. Infine, la Camera debitamente preso in considerazione il contenuto dell'art. 7 par. 1 del Regolamento di applicazione e ha dichiarato che l'importo indicativo di cui sopra deve essere moltiplicato per il numero di anni di formazione da 12 a 21, in casu quindi un solo anno. Tenuto conto di quanto sopra, la Camera di Risoluzione delle Controversie concluso che la S. club deve versare al club K. importo di USD 40'000 a titolo di risarcimento formazione connesse al trasferimento dei diritti federativi della decisione del giocatore J. la risoluzione delle controversie Camera 1. L'affermazione del K. club è accettata. 2. S. Il club è rivolto a versare l'importo di USD 40'000 al K. Club 3. La somma dovuta alla K. squadra deve essere pagato dal club di S. entro 30 giorni dalla data di notifica della presente decisione. 4. Se la somma corrispondente non viene pagata entro il termine di cui sopra, la questione attuale deve essere presentata alla Commissione Disciplinare della FIFA, in modo che le necessarie sanzioni disciplinari possono essere imposte. 5. Ai sensi dell'art. 60 par. 1 dello Statuto della FIFA che tale decisione può essere impugnata dinanzi alla Corte di Arbitrato per lo Sport (CAS). La dichiarazione di ricorso deve essere inviato direttamente al CAS entro 10 giorni dal ricevimento della notifica della presente decisione e deve contenere tutti gli elementi di cui al punto 2 delle direttive impartite dal CAS, copia della quale si allega alla presente. Entro altri 10 giorni successivi alla scadenza del termine per la presentazione della dichiarazione di ricorso, la ricorrente deve depositare presso la CAS una breve indicazione dei fatti e argomenti giuridici che danno origine al ricorso (cfr. punto 4 delle direttive). According to the Football Association, with which the club S. is affiliated, he joined its club in a non-amateur capacity. • The club K. claims training compensation in accordance with Chapter VII. of the FIFA Regulations for the Status and Transfer of Players. • According to the FIFA circular no. 826 dated 31 October 2002, which regards, inter alia, the categorisation of clubs, the club K. is a second division club, belonging to category 2. The club S. is a first division club, belonging to category 2. • The club S. offered to pay the amount of USD 10’000. Allegedly, this corresponds to the average amount of the training costs normally spent by clubs of that country per year divided by the average number of players in a club. The club K., however, refuses this offer and deems that the training compensation should be calculated on the basis of the FIFA regulations and circulars. Considerations of the Dispute Resolution Chamber The members of the Dispute Resolution Chamber were summoned to pass a decision on this matter by the Chairman pursuant to art. 1 point 6) of the Rules Governing the Practice and Procedures of the Dispute Resolution Chamber. The deciding body commenced its deliberations by referring to art. 42 par. 1 lit. (b) (iv) of the FIFA Regulations for the Status and Transfer of Players (hereinafter: the Regulations), according to which it falls within the purview of the Dispute Resolution Chamber to review disputes concerning training compensation fees. Consequently, the Chamber established that it was competent to deal with the present affair. Subsequently, and entering into the substance of the matter, the Chamber acknowledged that Chapter VII. of the Regulations establishes, inter alia, that training compensation is payable for training incurred between the ages of 12 and 21, if the player concludes a non-amateur contract before the age of 23. The deciding body outlined that, in the case at hand, the training period to be taken into consideration is the sporting season 2002/2003 when the player J. was between 18 and 19 years old. Furthermore, it emphasised that at the time of his transfer to the club S. the player in question was 19 years old, and that he joined his new club in a non-amateur capacity. In view of the above, the Dispute Resolution Chamber concluded that, undisputedly, the club K. is entitled to receive compensation for the training and education of the player J. for the sporting season that the player spent with the club K. In continuation, the Chamber explained that the amount due by the club S. is to be calculated in accordance with art. 7 of the FIFA Regulations governing the Application of the Regulations for the Status and Transfer of Players (hereinafter: the Application Regulations), by applying the parameters provided by the FIFA circular letter no. 826 dated 31 October 2002. According to art. 7 par. 3 of the Application Regulations, as a general principle, the relevant compensation is determined by the training and education costs of the country in which the new club is located. In this respect, and so as to clarify the meaning of that clause, the deciding body referred to point 2., b., (i) of the FIFA circular letter no. 769 dated 24 August 2001 and acknowledged that, in cases of a transfer of a player from a country inside the EU/EEA to a country outside the EU/EEA, whenever training compensation is due it shall be based on the costs of the country of the new club while taking the category of the club which has effectively trained the player. Art. 7 par. 1 of the Application Regulations confirms the said principle (“The compensation for the training and education shall be obtained by multiplying the amount corresponding to the category of the training club …”) (it is us who emphasise). The Dispute Resolution Chamber recalled that the claiming club K. is a second division club, belonging to category 2 and furthermore, that the player J. was transferred to a club of the Asian region. The circular letter no. 826 establishes that the indicative amount of category 2 for the country of the club S. (Asia) is USD 40’000 per year of training. Finally, the Chamber duly took into consideration the contents of art. 7 par. 1 of the Application Regulations and stated that the aforementioned indicative amount needs being multiplied by the number of years of training from 12 to 21, in casu thus one year only. Taking into account all of the above, the Dispute Resolution Chamber concluded that the club S. must pay to the club K. the amount of USD 40’000 as training compensation related to the transfer of the federative rights to the player J. Decision of the Dispute Resolution Chamber 1. The claim of the club K. is accepted. 2. The club S. is directed to pay the amount of USD 40’000 to the club K. 3. The sum due to the club K. has to be paid by the club S. within 30 days as from the date of notification of the present decision. 4. If the relevant amount is not paid within the aforementioned deadline, the present matter shall be submitted to the Disciplinary Committee of FIFA, so that the necessary disciplinary sanctions may be imposed. 5. According to art. 60 par. 1 of the FIFA Statutes this decision may be appealed before the Court of Arbitration for Sport (CAS). The statement of appeal must be sent to the CAS directly within 10 days of receiving notification of this decision and has to contain all elements in accordance with point 2 of the directives issued by the CAS, copy of which we enclose hereto. Within another 10 days following the expiry of the time limit for the filing of the statement of appeal, the appellant shall file with the CAS a brief stating the facts and legal arguments giving rise to the appeal (cf. point 4 of the directives).
