I. Fatti della controversia 1. Il 22 agosto 2007, la L club (in prosieguo: il Convenuto) e K, un giocatore ' agente autorizzato dalla Federcalcio P (di seguito: il Richiedente), hanno sottoscritto un accordo (in prosieguo: l 'accordo), per mezzo del quale il convenuto accettato di pagare l'attore una commissione per un importo di 20.000 euro "per le attività di intermediazione in materia dei negoziati di prestito del giocatore A "(di seguito: il giocatore). 2. Secondo l'accordo, nel caso in cui il Resistente "decide di utilizzare la loro opzione a firmare il giocatore su base permanente, dopo il periodo di prestito, l'agente riceverà una commissione per quanto riguarda la sua tassa per intermediario riguardanti il trasferimento definitivo del giocatore. Agente riceverà un compenso per un importo di 20 000 euro, da pagare entro 14 giorni dalla data di acquisto del giocatore da club E ". 3. Su circa 22 agosto 2007, il Resistente e il giocatore hanno concluso un contratto di lavoro che specificamente stabilito che "Il presente contratto è l'intervento del Procuratore K che rappresenta il giocatore". 4. Il 2 settembre 2008, l'attore ha presentato un reclamo contro la FIFA Resistente per violazione del contratto. A questo proposito, l'attore ha affermato che, sebbene il convenuto aveva usato l'opzione per il trasferimento definitivo del giocatore, che non gli aveva pagato la commissione concordato nel contratto stipulato tra le parti in data 22 agosto 2007. 5. Di conseguenza, l'attore ha chiesto da parte del Resistente l'importo di EUR 20.000, oltre interessi di mora a decorrere dal 12 gennaio 2008. 6. Il 26 marzo 2010, il convenuto fornito FIFA con la sua risposta alla domanda e totalmente respinte. A questo proposito, il Resistente ha sostenuto che l'attore aveva rappresentato sia il giocatore e il club, poiché in base al contratto di lavoro stipulato tra il Resistente e il giocatore, l'attore è stato in qualità di rappresentante del giocatore. 7. Inoltre, secondo il convenuto, un giorno dopo la firma del suddetto contratto di lavoro, l'attore "con l'intenzione di trarre profitto da entrambe le parti [...] in procedure di trasferimento del giocatore, richiesto da S a firmare un accordo che ha scritto e allegato ai documenti presenti, senza la quale darebbe istruzioni al club in cui il giocatore veniva da non inviare il trasferimento del ITC ". 8. In conseguenza di quanto sopra esposto, il convenuto ha sostenuto di aver sentito obbligato a firmare l'accordo con l'attore, "anche se il fatto era completamente contro la sua volontà, per l'agente identificato rappresentato durante questo trasferimento esclusivamente gli interessi del giocatore". 9. Il 21 giugno 2010, l'attore ha presentato la sua risposta a quello del convenuto la posizione. A questo proposito, ha riconosciuto che era l'agente del giocatore al momento della transazione in questione, ma ha sostenuto che l'accordo concluso con la convenuta esplicitamente affermato che il Resistente era "responsabile del pagamento l'attore per quanto riguarda le modalità di cui in precedenza" . Inoltre, l'attore ha affermato che egli "non era affatto che intendono trarre profitto da entrambe le parti e non ha ricevuto alcuna remunerazione dal lettore". 10. In seguito, l'attore ha dichiarato che "mentre in qualità di intermediario in materia di trasferimento e l'eventuale prestito del giocatore, è stato che rappresenta la giocatore. Come risultato delle azioni del richiedente il giocatore è stato introdotto per il club. Esclusivamente il Richiedente negoziato i termini e le condizioni del (libero) prestito E da club e in questo senso, è stato che agisce per conto del convenuto ". Inoltre, l'attore ha sostenuto che l'accordo è stato firmato il 22 agosto 2007, vale a dire prima che l'edizione 2008 del Regolamento degli agenti di giocatori, "una dichiarazione scritta consenso del giocatore per il club a pagare l'agente non era necessaria in questo caso ". 11. Infine, l'attore ha respinto l'accusa del Resistente che aveva costretto quest'ultimo a firmare l'accordo il 22 agosto 2007. 12. Il 12 gennaio 2011, il convenuto ha presentato le sue osservazioni finali fino all'ultimo presentazione del Richiedente e semplicemente ribadito le argomentazioni presentate in precedenza. 13. Il 29 settembre 2011, l'attore ha informato FIFA che non era stato remunerato dal giocatore successivo prestito di quest'ultimo al club. 14. Per dimostrare quanto sopra, l'attore ha allegato una lettera apparentemente firmata da il giocatore, che contiene la seguente dichiarazione: "Qui mi confermano che, secondo i termini concordati con la L, la remunerazione per K agente autorizzato di giocatori, riguardanti il mio prestito a L, doveva essere coperto dalla L club". 15. Inoltre, l'attore in allegato il contratto di rappresentanza, firmato con la giocatore il 4 novembre 2005, che nel suo articolo 5, illuminato. 1, stabilito come segue: "Il Giocatore si impegna a pagare alla Commissione Agent sul valore del contratto firmato da il lettore per tutta la durata del presente contratto. Tale commissione è pari al 10% (per esempio: dieci per cento) sull'importo lordo dovuto al giocatore per il contratto esecuzione. Allo stesso tempo, il Giocatore accetta irrevocabilmente che l'agente riceverà tale commissione direttamente dal club acquisire il giocatore. Pagamento di tale disposizione deve avvenire immediatamente dopo l'esecuzione del contratto con il club dal giocatore ed è pari al 10% (per esempio: dieci per cento) dell'importo totale dovuto per il giocatore per tutti gli anni della durata del contratto medesimo. In tal caso, l'agente non riceverà alcun costo aggiuntivo dal lettore ". II. Considerazioni del giudice unico di Commissione per lo Status dei Calciatori 1. Prima di tutto, il giudice unico del Comitato per lo Status dei Calciatori (di seguito: Giudice unico), che ha analizzato le norme procedurali sono applicabili alla materia in mano. A questo proposito, e dato che la presente domanda è stata presentata alla FIFA il 2 Settembre 2008, il giudice unico ha concluso che l'attuale edizione del Regolamento Che disciplinano le procedure di Commissione per lo Status del Calciatore e la Disputa Camera di Risoluzione (edizione 2008, in prosieguo: le norme procedurali) è applicabile alla materia in esame (cfr. art. 21 par. 2 e 3, del regolamento di procedura). 2. Successivamente, il giudice unico ha analizzato l'edizione di agenti di giocatori FIFA Regolamenti devono essere applicabili. A questo proposito, si conferma che ai sensi dell'art. 39 paragrafo. 1 e 4 della edizione 2008 di giocatori Regolamento Agenti, e considerando che la presente domanda è stata presentata il 2 settembre 2008, l'edizione attuale di giocatori Regolamento Agenti (edizione 2008, in prosieguo: il Regolamento) si applica al presente materia. 3. Inoltre, e per quanto riguarda la sua competenza, il giudice unico ha sottolineato che ai sensi dell'art. 30 par. 2 del Regolamento, la FIFA è competente a trattare le controversie internazionali in connessione con le attività di giocatori tesserati ' agenti, ossia i singoli titolari di licenza di agente di calciatori validi rilasciati dagli membro dell'Associazione rilevante. Ciò stabilito, il giudice unico ha sottolineato che la questione in esame riguarda una controversia tra un agente di calciatori autorizzato dalla Football Association P e un centro di T, in vista di un eccezionale presunto commissione. Di conseguenza, il giudice unico ha dichiarato che egli era competente ad decidere in merito alla questione attuale che ha una dimensione internazionale. 4. La sua competenza e le norme vigenti che sono stati istituiti, e entrare nel merito della questione presente, il giudice unico ha iniziato riconoscendo i fatti accertati del caso di specie e degli argomenti delle parti, nonché i documenti contenuti nel file. 5. In particolare, il giudice unico ha osservato che l'attore e il convenuto concluso un accordo di rappresentanza, in base al quale il lavoratore è stato il diritto di ricevere una commissione da parte del Resistente, pari a 20.000 euro, "Per agire come intermediario per i negoziati di prestito del giocatore". 6. Inoltre, il giudice unico ha osservato che, prima che l'accordo di cui sopra è stato concluso, l'attore e il giocatore aveva anche concluso una rappresentazione accordo, che prevedeva, tra l'altro, che "[...] il Giocatore accetta irrevocabilmente che l'agente deve ricevere tale [suo] incarico direttamente dal club acquisire il giocatore ". 7. A questo proposito, il giudice unico ha anche sottolineato il contenuto del lettore è scritto dichiarazione, per mezzo del quale egli ha affermato che "Qui mi confermano che, secondo i termini concordati con la L, la remunerazione per K agente autorizzato di giocatori, riguardanti il mio prestito a L, doveva essere coperto dalla L club". 8. In seguito, il giudice unico di cui i principali argomenti delle parti e ha rilevato che il ricorrente ha sostenuto che il Resistente aveva violato il accordo che aveva stipulato con quest'ultimo, non effettuando il pagamento della concordato commissioni per un importo di 20.000 euro. Il giudice unico ha inoltre preso atto che il ricorrente aveva riconosciuto che è stato anche il giocatore che rappresenta nel corso dei negoziati relativi, ma aveva sostenuto che non era "Con l'intenzione di trarre profitto da entrambe le parti e che non ha ricevuto alcun compenso dal lettore ". 9. Per quanto riguarda la posizione del Resistente, il giudice unico constatato che quest'ultimo respinto la domanda del ricorrente sostenendo l'esistenza di un conflitto di interessi a causa del fatto che il richiedente è stato che rappresenta il giocatore e il convenuto nella stessa transazione. 10. In considerazione di quanto sopra, il Giudice unico era ansioso di sottolineare che la disposizione secondo la quale l'agente di calciatori può rappresentare gli interessi di una parte in una transazione e che è contenuto nella versione corrente del Regolamento così come nella versione che era in vigore al momento in cui il richiedente aveva concluso gli accordi di rappresentanza sia con il giocatore e il Resistente il 4 novembre 2005 e del 22 agosto 2007, rispettivamente, (vale a dire del 2001 edizione del Regolamento degli agenti di giocatori), è stato adottato, tra le altre cose, in al fine di garantire che l'agente di calciatori non è remunerato due volte per i servizi che rende in una stessa transazione. 11. In seguito, il giudice unico di cui al nuovo testo della rappresentazione accordo firmato tra l'attore e il giocatore, il 4 Novembre 2005, e ha sottolineato che le parti avevano espressamente convenuto che il "[...] Agente riceverà tale commissione direttamente dal club acquisire il giocatore" e che "[...] l'agente non beneficiano di costi aggiuntivi dal lettore". Inoltre, il giudice unico ha inoltre osservato che il giocatore aveva confermato nella sua dichiarazione scritta che la remunerazione concordata da e tra lui e l'attore doveva essere coperti dal Resistente. 12. In considerazione di quanto sopra, il giudice unico riteneva che, sebbene la Attore sembra aver rappresentato il convenuto e il giocatore nella stessa transazione, le prove documentali contenute nel fascicolo dimostra chiaramente che il ricorrente non avrebbe potuto forse stati remunerati due volte per i suoi servizi. Di conseguenza, e in conformità con i principi generali di buona fede e pacta sunt servanda il giudice unico ha deciso che il Resistente deve soddisfare la obbligo volontariamente stipulato con l'attore per mezzo del accordo di rappresentanza concluso tra le parti, e, quindi, la Convenuto deve versare al ricorrente per i servizi resi in relazione a il trasferimento del giocatore al Resistente. Come conseguenza, il giudice unico ha concluso che la domanda del ricorrente è accettata, e quindi il Resistente deve pagare al ricorrente l'importo di 20.000 euro, con interessi del 5% su detto importo a partire dal 12 gennaio 2008, come richiesto dalla parte attrice. 13. Inoltre, per motivi di buon ordine e in risposta alle accuse che l'attore aveva messo pressione sul Resistente in modo che a firmare il accordo di rappresentanza, il giudice unico ha ritenuto che tali accuse non poteva essere presi in considerazione in quanto non erano supportate da alcuna prova documentale. 14. Fatte salve le considerazioni di cui sopra, il giudice unico ha voluto sottolineare che l'obbligo degli agenti di giocatori di evitare situazioni di conflitto di interesse devono svolgere le proprie attività in ogni momento. Tale obbligo implica che un agente di calciatori, che è legato ai principi di lealtà e correttezza, non possono rappresentare gli interessi delle due parti in una stessa transazione, a causa del fatto che, tra l'altro, le stesse possono avere interessi negativi. A questo proposito, il giudice unico ha inoltre aggiunto che, anche se tale conflitto di interessi non implica necessariamente che la missione agente di calciatori è eseguito in modo errato in un caso particolare, la sola possibilità di una situazione di conflitto di interessi, di per sé e in base al Regolamento, riprovevole. 15. Di conseguenza, a causa del fatto che il Richiedente ha concluso due accordi di rappresentanza (ad esempio uno con il giocatore e quello con il Resistente) che erano ancora valido al momento dell'operazione rilevante e sulla base di art. 19 par. 8 in relazione con l'arte. 30 par. 3 et. ss. del Regolamento, il Giudice unico ha dichiarato che il file presente deve essere presentata alla Commissione Disciplinare della FIFA, al fine di avviare un procedimento disciplinare nei confronti del richiedente per una possibile violazione del Regolamento. 16. Infine, il giudice unico di cui all'art. 25 par. 2 del Regolamento in combinazione con l'art. 18 par. 1 del Regolamento di procedura, secondo cui, nel procedimento dinanzi alla commissione per lo Status dei Calciatori, compreso il suo giudice unico, i costi per un importo massimo di CHF 25'000 di prelevamento. La disposizione precisa inoltre che i relativi costi sono a carico in considerazione del grado delle parti di successo nel procedimento. 17. Inoltre, e secondo all 'allegato A, del regolamento di procedura, le spese del procedimenti devono essere prelevati sulla base del valore di causa. Il valore della controversia da prendere in considerazione nel presente procedimento è pari a 20.000. Pertanto, il giudice unico ha concluso che l'importo massimo delle spese del procedimento corrisponde a CHF 5000. 18. Considerando che il caso in questione non ha posto particolari difficoltà di fatto o di complessità giuridica, il giudice unico determinato le spese del procedimento in corso ad un importo di CHF 2'000. 19. In conclusione, l'importo di CHF 2000 deve essere pagato da parte del Resistente in ordine a coprire le spese del presente procedimento. III. Decisione del giudice unico di Commissione per lo Status dei Calciatori 1. La richiesta del Richiedente, K, è accettato. 2. Il Resistente, L, deve pagare all'attore, K, l'importo di 20.000 euro, come così come il 5% di interesse annuo del detto importo a partire dal 12 gennaio 2008 fino data di effettivo pagamento, entro 30 giorni dalla data di notifica della presente decisione. 3. Se la somma di cui sopra non viene pagata entro il termine suddetto, la presente questione deve essere presentata, su richiesta, alla commissione disciplinare della FIFA per l'esame e una decisione formale. 4. Le spese del procedimento per un importo di CHF 2000 sono a carico del Resistente, L, entro 30 giorni a decorrere dalla notifica della presente decisione, in quanto segue: 4.1 L'importo di CHF 1000 alla FIFA, al seguente conto bancario, con riferimento al caso nr. 09-01835/gbo: UBS Zurigo Numero di conto 366.677.01U (Stato Calciatori) Cancellazione numero 230 IBAN: CH27 0023 0230 3666 7701 U SWIFT: UBSWCHZH80A 4.2 L'importo di CHF 1'000 all'attore, K. 5. Il Richiedente, K, è diretta ad informare il Resistente, L, immediatamente e direttamente del numero di conto sul quale l'invio di cui ai punti 2 e 4.2 deve essere fatto e di informare Commissione per lo Status dei Calciatori di ogni pagamento ricevuto. 6. L'intero file è presentata alla Commissione Disciplinare della FIFA, al fine di avviare un procedimento disciplinare nei confronti del Richiedente, K, in relazione alla presente materia [cfr. art. 19 par. 8 in relazione con l'arte. 30 par. 3 et. ss. del Regolamento di agente di giocatori (edizione 2008)]. Nota relativa alla decisione motivata (ricorso giurisdizionale): Ai sensi dell'art. 63 par. 1 dello Statuto della FIFA, questa decisione può essere impugnata dinanzi al Tribunale Arbitrale dello Sport (TAS). La dichiarazione di ricorso deve essere inviato a il CAS direttamente entro 21 giorni dal ricevimento della notifica della presente decisione e contiene tutti gli elementi di cui al punto 2 delle direttive emanate dal CAS, un copia della quale si allega alla presente. I. Facts of the case 1. On 22 August 2007, the club L (hereinafter: the Respondent) and K, a players’ agent licensed by the Football Association P (hereinafter: the Claimant), signed an agreement (hereinafter: the agreement), by means of which the Respondent agreed to pay the Claimant a commission in the amount of EUR 20,000 “for acting as intermediary in respect of the negotiations of loan of the player A” (hereinafter: the player). 2. According to the agreement, in case the Respondent “decides to use their option to sign the player on permanent basis after the loan period, the agent will receive a commission regarding it’s fee for intermediary regarding the permanent transfer of the player. Agent will receive a remuneration in the amount of 20 000 euro, payable within 14 days from the date of buying the player from club E”. 3. On or about 22 August 2007, the Respondent and the player concluded an employment contract which specifically stipulated that “This contract has the intervention of the Player Agent K representing the player”. 4. On 2 September 2008, the Claimant lodged a claim with FIFA against the Respondent for breach of the agreement. In this respect, the Claimant claimed that although the Respondent had used its option for the definite transfer of the player, it had not paid him the commission agreed upon in the agreement concluded between the parties on 22 August 2007. 5. Consequently, the Claimant requested from the Respondent the amount of EUR 20,000, plus default interest as from 12 January 2008. 6. On 26 March 2010, the Respondent provided FIFA with its response to the claim and rejected it entirely. In this respect, the Respondent claimed that the Claimant had represented both the player and the club, since according to the employment contract concluded between the Respondent and the player, the Claimant was acting as the player’s representative. 7. Furthermore, according to the Respondent, one day after signing the aforesaid employment contract, the Claimant “intending to profit from both sides […] in the player’s transfer procedures, demanded from L to sign a deal that he wrote down and attached to the present documents, without which would give instructions to the club where the player was coming from not to dispatch the transfer of the ITC”. 8. As a result of the above, the Respondent argued that it had felt compelled to sign the agreement with the Claimant, “although the fact was completely against its will, for the identified agent represented during this transfer exclusively the interests of the player”. 9. On 21 June 2010, the Claimant presented his response to the Respondent’s position. In this respect, he acknowledged that he was the agent of the player at the time of the relevant transaction but claimed that the agreement concluded with the Respondent explicitly stated that the Respondent was “responsible for paying the Claimant in respect of the manner listed hereinabove”. In addition, the Claimant claimed that he “was by no means intending to profit from both sides and he did not receive any remuneration from the player”. 10. In continuation, the Claimant stated that “while acting as an intermediary in respect of the loan and possible transfer of the player, he was representing the player. As a result of the Claimant’s actions the player was introduced to the club. Exclusively the Claimant negotiated the terms and conditions of the (free) loan from club E and in this respect, was acting on behalf of the Respondent”. Furthermore, the Claimant argued that as the agreement was signed on 22 August 2007, i.e. before the 2008 edition of the Players’ Agents Regulations, “a written consent of the player for the club to pay the agent was not necessary in this case”. 11. Finally, the Claimant rejected the allegation of the Respondent that he had compelled the latter to sign the agreement on 22 August 2007. 12. On 12 January 2011, the Respondent presented its final comments to the last submission of the Claimant and simply reiterated the argumentation previously submitted. 13. On 29 September 2011, the Claimant informed FIFA that he had not been remunerated by the player following the latter’s loan to the club. 14. In order to prove the above, the Claimant enclosed a letter apparently signed by the player, containing the following statement: “Here I confirm that according to the agreed terms with L, the remuneration for players’ licensed agent K, concerning my loan to L, was supposed to be covered by the club L”. 15. Moreover, the Claimant enclosed the representation agreement, signed with the player on 4 November 2005, which in its article 5, lit. 1, stipulated as follows: “The Player undertakes to pay to the Agent commission on the contract value signed by the Player during the term of this agreement. Such commission shall amount to 10% (say: ten per cent) on the gross amount due to the Player for the contract execution. At the same time, the Player irrevocably agrees that the Agent shall receive such commission directly from the club acquiring the Player. Payment of such provision shall occur immediately after execution of the contract with the club by the Player and shall amount to 10% (say: ten per cent) of the full amount due to the Player for all the years of the term of such contract. In such case, the Agent shall not receive any additional fees from the Player”. II. Considerations of the Single Judge of the Players’ Status Committee 1. First of all, the Single Judge of the Players’ Status Committee (hereinafter: the Single Judge) analysed which procedural rules are applicable to the matter at hand. In this respect, and since the present claim was submitted to FIFA on 2 September 2008, the Single Judge concluded that the current edition of the Rules Governing the Procedures of the Players’ Status Committee and the Dispute Resolution Chamber (edition 2008; hereinafter: the Procedural Rules) is applicable to the matter at hand (cf. art. 21 par. 2 and 3 of the Procedural Rules). 2. Subsequently, the Single Judge analysed which edition of the FIFA Players’ Agents Regulations should be applicable. In this respect, he confirmed that in accordance with art. 39 par. 1 and 4 of the 2008 edition of the Players’ Agents Regulations, and considering that the present claim was lodged on 2 September 2008, the current edition of the Players’ Agents Regulations (edition 2008; hereinafter: the Regulations) is applicable to the present matter. 3. Furthermore and with regard to his competence, the Single Judge pointed out that in accordance with art. 30 par. 2 of the Regulations, FIFA is competent to deal with international disputes in connection with the activities of licensed players’ agents, i.e. individuals who hold a valid players’ agent licence issued by the relevant member Association. This established, the Single Judge underlined that the present matter concerns a dispute between a players’ agent licensed by the Football Association P and a club from T, regarding an alleged outstanding commission. As a consequence, the Single Judge held that he was competent to decide on the present matter which has an international dimension. 4. His competence and the applicable regulations having been established, and entering into the substance of the present matter, the Single Judge started by acknowledging the established facts of the case and the arguments of the parties as well as the documents contained in the file. 5. In particular, the Single Judge noted that the Claimant and the Respondent concluded a representation agreement, according to which the Claimant was entitled to receive a commission from the Respondent amounting to EUR 20,000, “for acting as intermediary in respect of the negotiations of loan of the player”. 6. Furthermore, the Single Judge noted that, before the aforementioned agreement was concluded, the Claimant and the player had also concluded a representation agreement, which stipulated, inter alia, that “[…] the Player irrevocably agrees that the Agent shall receive such [his] commission directly from the club acquiring the Player”. 7. In this respect, the Single Judge also underlined the content of the player’s written statement, by means of which he stated that “Here I confirm that according to the agreed terms with L, the remuneration for players’ licensed agent K, concerning my loan to L, was supposed to be covered by the club L”. 8. In continuation, the Single Judge referred to the main arguments of the parties and noted that the Claimant argued that the Respondent had breached the agreement he had concluded with the latter by not making payment of the agreed commission in the amount of EUR 20,000. The Single Judge also took note that the Claimant had acknowledged that he was also representing the player during the course of the relevant negotiations but had argued that he was not “intending to profit from both sides and he did not receive any remuneration from the player”. 9. As for the position of the Respondent, the Single Judge noted that the latter rejected the Claimant’s claim arguing the existence of a conflict of interest due to the fact that the Claimant was representing the player and the Respondent in the same transaction. 10. In view of the aforementioned, the Single Judge was eager to emphasise that the provision according to which a players’ agent may only represent the interests of one party in a transaction and which is contained in the current version of the Regulations as well as in the version which was in force at the time the Claimant had concluded the representation agreements with both the player and the Respondent on 4 November 2005 and 22 August 2007 respectively (i.e. the 2001 edition of the Players’ Agents Regulations), was enacted, among other things, in order to ensure that a players’ agent is not remunerated twice for the services he renders in a same transaction. 11. In continuation, the Single Judge referred again to the wording of the representation agreement signed between the Claimant and the player on 4 November 2005, and underlined that the parties had specifically agreed that the “[…] Agent shall receive such commission directly from the club acquiring the player” and that “[…] the Agent shall not receive any additional fees from the Player”. Furthermore, the Single Judge also noted that the player had confirmed in his written statement that the remuneration agreed by and between him and the Claimant was supposed to be covered by the Respondent. 12. In view of the above, the Single Judge formed the view that, although the Claimant appears to have represented the Respondent and the player in the same transaction, the documentary evidence contained in the file clearly demonstrates that the Claimant could not have possibly been remunerated twice for his services. Consequently, and in accordance with the general principles of bona fide and pacta sunt servanda the Single Judge decided that the Respondent must fulfill the obligation it voluntarily entered into with the Claimant by means of the representation agreement concluded between the parties, and therefore, the Respondent must pay the Claimant for the services he rendered in connection with the transfer of the player to the Respondent. As a consequence, the Single Judge concluded that the Claimant’s claim is accepted, and therefore the Respondent must pay to the Claimant the amount of EUR 20,000, together with 5% interest on the said amount as from 12 January 2008, as requested by the Claimant. 13. Furthermore, for the sake of good order and in response to the allegations that the Claimant had put pressure on the Respondent in order for it to sign the representation agreement, the Single Judge held that such allegations could not be taken into account as they were not supported by any documentary evidence. 14. Notwithstanding the above-mentioned considerations, the Single Judge was keen to point out that the obligation placed on players’ agents to avoid situations of conflict of interest should govern their activities at all times. This obligation implies that a players’ agent, who is bound by the principles of loyalty and fairness, cannot represent the interests of two parties in a same transaction, due to the fact that, inter alia, these parties may have adverse interests. In this respect, the Single Judge further added that even if such conflict of interest does not necessarily imply that the players’ agent’s mission is improperly carried out in a particular case, the sole possibility of a situation of conflict of interest is, in itself and according to the Regulations, reprehensible. 15. Consequently, on account of the fact that the Claimant had concluded two representation agreements (i.e. one with the player and one with the Respondent) which were still valid at the time of the relevant transaction and on the basis of art. 19 par. 8 in connection with art. 30 par. 3 et. seqq. of the Regulations, the Single Judge held that the present file has to be submitted to the Disciplinary Committee of FIFA in order to commence disciplinary proceedings against the Claimant for a possible infringement of the Regulations. 16. Finally, the Single Judge referred to art. 25 par. 2 of the Regulations in combination with art. 18 par. 1 of the Procedural Rules, according to which, in the proceedings before the Players’ Status Committee, including its Single Judge, costs in the maximum amount of CHF 25,000 are levied. The relevant provision further states that the costs are to be borne in consideration of the parties’ degree of success in the proceedings. 17. Furthermore and according to Annexe A of the Procedural Rules, the costs of the proceedings are to be levied on the basis of the amount in dispute. The amount in dispute to be taken into consideration in the present proceedings is EUR 20,000. Therefore, the Single Judge concluded that the maximum amount of costs of the proceedings corresponds to CHF 5,000. 18. Considering that the case at hand did not pose any particular factual difficulty or legal complexity, the Single Judge determined the costs of the current proceedings to the amount of CHF 2,000. 19. In conclusion, the amount of CHF 2,000 has to be paid by the Respondent in order to cover the costs of the present proceedings. III. Decision of the Single Judge of the Players’ Status Committee 1. The claim of the Claimant, K, is accepted. 2. The Respondent, L, has to pay to the Claimant, K, the amount of EUR 20,000, as well as 5% interest per year on the said amount as from 12 January 2008 until the date of effective payment, within 30 days as from the date of notification of this decision. 3. If the aforementioned sum is not paid within the aforementioned deadline, the present matter shall be submitted, upon request, to FIFA’s Disciplinary Committee for consideration and a formal decision. 4. The costs of the proceedings in the amount of CHF 2,000 are to be paid by the Respondent, L, within 30 days as from the notification of the present decision, as follows: 4.1 The amount of CHF 1,000 to FIFA, to the following bank account, with reference to case nr. 09-01835/gbo: UBS Zurich Account number 366.677.01U (FIFA Players’ Status) Clearing number 230 IBAN: CH27 0023 0230 3666 7701U SWIFT: UBSWCHZH80A 4.2 The amount of CHF 1,000 to the Claimant, K. 5. The Claimant, K, is directed to inform the Respondent, L, immediately and directly of the account number to which the remittance under points 2 and 4.2 is to be made and to notify the Players’ Status Committee of every payment received. 6. The entire file shall be submitted to FIFA’s Disciplinary Committee in order to commence disciplinary proceedings against the Claimant, K, in relation to the present matter [cf. art. 19 par. 8 in connection with art. 30 par. 3 et. seqq. of the Players Agent Regulations (edition 2008)]. Note relating to the motivated decision (legal remedy): According to art. 63 par. 1 of the FIFA Statutes, this decision may be appealed against before the Court of Arbitration for Sport (CAS). The statement of appeal must be sent to the CAS directly within 21 days of receipt of notification of this decision and shall contain all the elements in accordance with point 2 of the directives issued by the CAS, a copy of which we enclose hereto. Within another 10 days following the expiry of the time limit for filing the statement of appeal, the appellant shall file a brief stating the facts and legal arguments giving rise to the appeal with the CAS (cf. point 4 of the directives).
